The Platform X Wins Appeal to Allow Viewing for Australians to Charlie Kirk Video Content

Following a notable regulatory appeal, the Australian classification review board has reversed a prior decision that prevented viewers in Australia from accessing video footage of the shooting incident involving conservative commentator Charlie Kirk. The appeal was initiated by Elon Musk's social media platform, which contested an order sought by the online safety regulator.

Details of the Original Ban

Following the death of Charlie Kirk at a US campus in last year, the regulator petitioned the review board to officially classify the available footage. The board initially ruled the content was "unable to be classified", a designation that empowered the regulator to order social media companies to restrict access to the videos for users in Australia.

The platform X filed an appeal for two separate videos related to the Kirk incident. Additionally, it contested a similar ruling on a separate video—showing the assault of Iryna Zarutska on a North Carolina train—which had likewise been deemed "unacceptable for distribution".

The Platform's Case and Board's Decision

In its appeal, X contended that the footage in question contained only a short moment of violence with no visible weapon. The company noted the recording was low-quality and the camera quickly panned away from the individual to the bystanders.

The social media giant argued the video was not excessively detailed, gratuitous, or offensive, stating it served as a neutral objective record of "a significant incident of historical and political significance that generated extensive public discourse". X even compared the video and the historic film of the JFK shooting.

Most members of the classification panel concluded that, "despite the terrible nature of the event," the video did not reach a level that was exploitative, gratuitous, or offensive enough to warrant a 'refused classification' rating. However, they noted that a more detailed depiction with different editing could have resulted in a different ruling. As a result, the board revised the rating of the videos to R18+.

The Minority Viewpoint

A minority on the board disagreed, contending the post was "content designed for sharing for the probable aim of entertainment and/or personal gain (such as likes, shares, or views)". This view stated the comparison to the Zapruder JFK film was flawed, as that footage was made public long after the event, "after public sentiment regarding it had calmed".

Reactions to the Decision

Posting on its global government affairs account, X expressed approval of the decision.

"We challenged this case to uphold free speech and the critical nature of public access about issues of public interest. Our commitment remains committed to protecting these fundamental values."

Representatives for the eSafety commissioner acknowledged the board's decision, but pointed out that the revised classification now implies platforms "have obligations to ensure R18+ material being displayed to users under 18".

Broader Context on Sensitive Footage

In related news, the eSafety commissioner did not issue formal notices to social media companies this week regarding disturbing videos from the Sydney beach incident circulating on social media. The regulator stated that while the images were upsetting, they had not met the high threshold for a "total ban" rating.

As an alternative, platforms have been instructed to apply sensitive content labels and interstitials, such as blurring, on such content in accordance with their existing community guidelines.
